Key Rights Under Directive (EU) 2015/2302
- Travelers will receive all essential information about the package trip before entering into the package travel contract.
- There is always at least one trader who is liable for the proper performance of all travel services included in the contract.
- Travelers are provided with an emergency telephone number or contact details for reaching the organizer or travel agency.
- Travelers may transfer the package to another person, with reasonable notice and possibly subject to an additional cost.
- The price of the package may only be increased if specific costs rise (such as fuel prices), and only if this is explicitly stated in the contract — and no later than 20 days before the start of the package. If the price increases by more than 8% of the total package price, the traveler may terminate the contract. If the organizer reserves the right to increase the price, the traveler also has the right to a price reduction if the relevant costs decrease.
- Travelers may terminate the contract without paying a termination fee and receive a full refund of all payments if any of the essential elements of the package other than the price are significantly changed. If the trader responsible for the package cancels the package before its start, travelers are entitled to a refund and, where appropriate, compensation.
- Travelers may terminate the contract without paying a termination fee in the event of extraordinary circumstances — for example, if there are serious security problems at the destination that are likely to affect the package.
- Travelers may also terminate the contract at any time before the start of the package in exchange for a reasonable and justifiable cancellation fee.
- If significant parts of the package cannot be delivered as agreed after the trip has started, suitable alternative arrangements must be offered at no extra cost. Travelers may terminate the contract without paying a termination fee if the services are not provided as agreed and this substantially affects the fulfillment of the package, and the organizer fails to fix the problem.
- Travelers are also entitled to a price reduction and/or compensation for damages if the travel services are not performed or are performed poorly.
- The organizer is obliged to provide assistance if the traveler is in difficulty.
- If the organizer or, in some EU member states, the retailer becomes insolvent, payments will be refunded. If insolvency occurs after the start of the package and transport is included in the package, the traveler’s repatriation is secured.
