Booking Terms & Conditions for Fokus Fotoresor

Welcome to Fokus Fotoresor. These Booking Terms & Conditions apply to all bookings made with Fokus Fotoresor i Sverige AB unless otherwise stated for a specific trip.
These Terms are designed for package travel bookings and should be read together with the trip-specific information published on the relevant trip page, your booking confirmation, invoice, and any additional pre-contractual information provided before booking.
Booking Terms in Brief
- A deposit is required to secure your place.
- Final payment is normally due 30 days before departure, unless otherwise stated.
- Cancellation fees apply according to the time of cancellation and the nature of the trip.
- Some trips may be subject to trip-specific terms, including special payment schedules, cancellation conditions, permit fees, or accommodation terms.
- Prices are normally based on shared accommodation, unless a single room is booked or required.
- You are responsible for holding valid passport, visa, insurance, vaccination records, and any other required travel documents.
- Comprehensive travel insurance is strongly recommended and may be mandatory for certain trips.
- These Terms are governed by Swedish law, subject to any mandatory consumer protection rights that may apply under applicable law.
Full Terms & Conditions
1. The Agreement
1.1 The Organizer
The organizer of the trip is Fokus Fotoresor i Sverige AB (“Fokus Fotoresor”, “we”, “us”, or “our”).
Fokus Fotoresor is responsible to the traveler for what the traveler is entitled to claim under the agreement and under applicable package travel legislation.
1.2 Lead Traveler
The Lead Traveler is the person in whose name the booking is made. The Lead Traveler is identified first in the booking confirmation or otherwise clearly indicated.
The Lead Traveler is responsible for payment under the agreement and for ensuring that all travelers covered by the booking receive relevant information from Fokus Fotoresor.
All changes, requests, and any cancellation of the booking must be made by the Lead Traveler, unless special circumstances apply.
The Lead Traveler is also responsible for ensuring that all booking details provided to Fokus Fotoresor are accurate and complete for all travelers included in the booking.
1.3 Travelers Under 18 Years of Age
If a traveler is under 18 years of age and is traveling without a parent or legal guardian, this must be disclosed at the time of booking.
Written consent from all legal guardians must be submitted to Fokus Fotoresor before payment is made, unless otherwise agreed in writing.
1.4 Information Obligation
Fokus Fotoresor shall keep the traveler informed of matters of significance to the traveler that are connected to the agreement and the booked trip.
1.5 Connecting Travel and Additional Arrangements
Connecting travel, pre-night stays, transfers, or other additional arrangements form part of the agreement only if they have been sold or marketed by Fokus Fotoresor together with the main trip as part of the same package or as linked arrangements under applicable law.
1.6 When the Agreement Becomes Binding
The agreement becomes binding when:
- Fokus Fotoresor has confirmed the booking in writing, and
- the traveler has paid the agreed deposit within the stated time.
1.7 Booking Confirmation
Fokus Fotoresor shall confirm the traveler’s booking without undue delay.
1.8 Special Requests
Special requests, including but not limited to room preferences, dietary preferences, equipment handling preferences, or other individual arrangements, are not guaranteed unless expressly confirmed by Fokus Fotoresor in writing.
1.9 Review of Booking Documents
The traveler is responsible for checking the booking confirmation, invoice, and travel documents as soon as they are received.
Any errors or discrepancies must be reported to Fokus Fotoresor without delay.
Fokus Fotoresor reserves the right to charge a reasonable administrative fee for correcting information that was provided incorrectly by the traveler.
1.10 Flight Information
Any traveler arriving by air and/or departing by air must provide Fokus Fotoresor in writing by email with:
- arrival date and time,
- departure date and time,
- flight number(s),
- and any material schedule changes.
This information is required so that transfers, pickups, and related arrangements can be planned appropriately.
The traveler must also comply with any latest arrival time and earliest permitted departure time stated by Fokus Fotoresor for the trip.
2. Payment
2.1 Payment of the Trip Price
The traveler shall pay the trip price in accordance with the payment terms stated in the agreement, booking confirmation, invoice, or trip-specific information.
2.2 Final Payment
Unless otherwise stated, final payment must be received by Fokus Fotoresor no later than 30 days before departure.
2.3 Deposit
At the time of booking, Fokus Fotoresor will charge a deposit of up to 20% of the total trip price, unless a different deposit amount is specified for the relevant trip.
The deposit must be paid no later than 14 days after the invoice has been issued, unless otherwise stated.
2.4 Late Bookings
If a booking is made after the final payment due date, the full trip price must be paid within 4 days from the date of booking, unless otherwise stated in writing.
2.5 Non-Payment
If the traveler fails to pay the trip price in accordance with the agreement, Fokus Fotoresor has the right to terminate the agreement and retain the deposit as compensation, subject to applicable law.
2.6 Shared Accommodation
Unless otherwise stated, trip prices are based on shared double occupancy.
If a traveler occupies a double room, twin room, or other shared accommodation alone, Fokus Fotoresor is entitled to charge the applicable single supplement.
2.7 Shared Room Without Available Roommate
If a traveler has booked a shared room and no suitable roommate can be arranged, Fokus Fotoresor has the right to charge a single supplement.
Where a single supplement is stated on the trip page or in the trip facts, that amount shall apply.
Fokus Fotoresor will notify the traveler no later than 7 days before the final payment due date if a single supplement must be paid due to the absence of a roommate.
2.8 Trip-Specific Payment Terms
Certain trips may be subject to different payment deadlines or special financial terms. Any such conditions will be stated on the trip page, in the booking material, or on the invoice.
2.9 Credit Assessment
If all or part of the trip is to be paid after booking or after departure, Fokus Fotoresor may carry out a credit assessment where permitted by law. Fokus Fotoresor reserves the right to do so, particularly in relation to new or relatively new customers.
3. Cancellation by the Traveler
3.1 Right to Cancel
The traveler has the right to cancel the trip at any time before the trip begins.
3.2 Cancellation Fees
If the traveler cancels the trip, Fokus Fotoresor is entitled to charge a reasonable cancellation fee.
Unless special trip-specific terms apply, the cancellation fee is as follows:
- 60 days or more before departure: the deposit
- 59 to 30 days before departure: 50% of the total trip price
- 29 days or less before departure: 100% of the total trip price
These cancellation fees have been determined with reference to:
- the timing of cancellation,
- expected cost savings,
- and the possibility of reselling the place.
Upon request, Fokus Fotoresor will provide information on how the cancellation fee has been calculated.
3.3 Extraordinary and Unavoidable Circumstances
No cancellation fee will be charged if the traveler terminates the agreement before the trip begins due to unavoidable and extraordinary circumstances occurring at the destination or in its immediate vicinity, where such circumstances significantly affect:
- the performance of the trip, or
- the carriage of passengers to the destination.
3.4 No Refund for Unused Services After Departure
Once the trip has started, no refund will be made for unused services or parts of the itinerary not taken up by the traveler, regardless of the reason, unless otherwise required by law.
3.5 Trip-Specific Cancellation Terms
Certain trips may be subject to special cancellation terms due to permits, charter arrangements, small-group logistics, fixed supplier commitments, or other non-recoverable costs.
Any such special cancellation terms will be clearly stated in connection with the booking and/or on the relevant trip page.
4. Changes Requested by the Traveler
4.1 Changes to a Booking
The traveler may request changes to the booking, but any such change is subject to approval by Fokus Fotoresor and to availability.
Approved changes may result in additional costs, including supplier fees, administrative charges, airfare change costs, accommodation charges, permit charges, or other actual costs incurred.
Fokus Fotoresor is under no obligation to approve a requested change where the requested amendment is impractical, unavailable, or disproportionate in cost or operational impact.
5. Transfer of the Booking
5.1 Right to Transfer
The traveler may transfer the booking to another person who satisfies all conditions applicable to the trip.
The traveler must notify Fokus Fotoresor in writing within a reasonable time before departure. Notice given no later than 7 days before departure shall always be considered to have been given in reasonable time.
Transfer is not available where included transport or other travel services are booked in the original traveler’s name and cannot legally or practically be changed under the supplier’s terms.
5.2 Liability and Transfer Fee
The original traveler and the new traveler are jointly and severally liable for:
- any outstanding balance,
- and any reasonable transfer fee or other costs arising from the transfer.
Any transfer fee charged by Fokus Fotoresor shall be reasonable and shall not exceed the actual costs arising from the transfer.
6. Changes Made by Fokus Fotoresor Before Departure
6.1 Changes to the Agreement
Fokus Fotoresor may change the terms of the agreement to the traveler’s disadvantage only where such a right is clearly reserved in the agreement and only to the extent permitted by applicable law.
If Fokus Fotoresor must make a significant change to the trip or cannot perform a material part of what has been agreed, the traveler shall be informed without undue delay and be informed of their rights.
6.2 Price Changes
Fokus Fotoresor may change the price of the trip only where this right has been reserved in the agreement and only as a direct result of changes in:
- the price of fuel or other power sources affecting the cost of passenger transport,
- taxes or fees imposed by third parties affecting travel services included in the trip,
- or exchange rates relevant to the package.
The traveler shall have a corresponding right to a price reduction if the relevant costs decrease for the same reasons.
Any price increase must be notified to the traveler no later than 20 days before departure and must include:
- the reason for the increase,
- and how the increase has been calculated.
6.3 Significant Price Increase
If the price increase exceeds 8% of the total trip price, the traveler has the right to terminate the agreement without paying a termination fee.
6.4 Minimum Number of Participants
If a trip is subject to a minimum number of participants, Fokus Fotoresor has the right to cancel the trip if too few travelers have booked.
If a trip is cancelled for this reason, the traveler shall be informed no later than:
- 20 days before departure for trips lasting more than 6 days,
- 7 days before departure for trips lasting between 2 and 6 days,
- 48 hours before departure for trips lasting less than 2 days.
6.5 Traveler’s Right to Terminate Due to Significant Changes
The traveler may terminate the agreement if Fokus Fotoresor makes a significant change to the trip and the change is of material importance to the traveler.
The traveler must notify Fokus Fotoresor of the decision to terminate within a reasonable time after receiving notice of the change. If the traveler fails to do so, the right to terminate may be lost.
6.6 Alternative Trip
If the traveler validly terminates the agreement under this section, the traveler is entitled to an alternative package of equivalent or higher quality, if Fokus Fotoresor is able to offer one.
If no suitable alternative can be offered, all payments made by the traveler shall be refunded without undue delay and no later than 14 days after termination of the agreement.
6.7 Compensation
The traveler may be entitled to compensation where required by applicable law.
However, the traveler is not entitled to compensation where:
- the trip is cancelled because the number of participants is lower than the minimum number stated and the traveler has been informed within the applicable time limit, or
- Fokus Fotoresor is prevented from performing the agreement due to unavoidable and extraordinary circumstances.
6.8 Unavoidable and Extraordinary Circumstances
Both Fokus Fotoresor and the traveler have the right to terminate the agreement if unavoidable and extraordinary circumstances arising after the agreement was concluded significantly affect:
- the performance of the trip, or
- the carriage of passengers to the destination.
7. Changes After Departure
7.1 Alternative Arrangements
If, after departure, a significant part of the agreed travel services cannot be provided, Fokus Fotoresor shall offer suitable alternative arrangements at no extra cost to the traveler, where required by law.
7.2 Price Reduction and Damages
If travel services are not performed in accordance with the agreement, the traveler may be entitled to an appropriate price reduction and/or damages, unless the lack of conformity is attributable to the traveler.
Fokus Fotoresor is not liable for damages where the lack of conformity is due to unavoidable and extraordinary circumstances.
7.3 Duty to Mitigate Loss
The traveler shall take reasonable steps to limit loss or damage as far as possible.
8. Complaints, Remedies, and Assistance
8.1 Complaint Obligation
The traveler may not rely on a defect, lack of conformity, or other issue unless Fokus Fotoresor is informed without undue delay after the traveler noticed, or ought reasonably to have noticed, the issue.
Where possible, the traveler should raise the issue during the trip and on site so that a remedy can be attempted immediately.
8.2 Remedy
If a complaint made during the trip is justified, Fokus Fotoresor shall take appropriate measures without undue delay in order to remedy the issue or find a suitable solution.
8.3 Assistance in Difficulty
Fokus Fotoresor shall provide appropriate assistance without undue delay if a traveler is in difficulty during the trip.
Such assistance may include, where relevant:
- information about health services,
- information about local authorities or consular assistance,
- practical assistance with communications,
- and help in finding alternative travel arrangements.
If the difficulty has been caused intentionally or negligently by the traveler, Fokus Fotoresor may charge a reasonable fee for such assistance, provided that the fee does not exceed the actual costs incurred.
9. Traveler Responsibilities During the Trip
9.1 Compliance With Instructions
The traveler must follow the instructions given by the tour leader, local guides, lodge staff, drivers, skippers, pilots, or any other person engaged by Fokus Fotoresor for the operation of the trip.
The traveler must behave in a manner that does not disrupt the trip or materially impair the safety, comfort, or experience of fellow travelers, staff, or local partners.
If the traveler materially breaches this obligation, Fokus Fotoresor has the right to terminate the traveler’s participation in the trip with immediate effect. In such case, the traveler shall not be entitled to any refund and shall be responsible for any additional costs caused by their conduct.
9.2 Damage Caused by the Traveler
The traveler is liable for any damage caused through negligence or wrongful conduct to Fokus Fotoresor, its staff, local partners, accommodation providers, transport providers, or third parties.
9.3 Health and Fitness to Travel
To participate in a trip, the traveler must be in sufficiently good health and physical condition for the itinerary, activities, climate, and travel conditions involved.
Any medical condition, dietary requirement, mobility limitation, allergy, disability, or other circumstance that may affect the traveler’s participation or the practical operation of the trip must be disclosed to Fokus Fotoresor before booking or, at the latest, before final payment.
Fokus Fotoresor reserves the right to decline participation or require a traveler to withdraw from all or part of a trip if, in the reasonable judgment of the tour leader, local operator, or relevant supplier, the traveler’s condition may pose a risk to:
- themselves,
- other participants,
- staff,
- or the safe and practical operation of the itinerary.
By paying the deposit or booking fee, the traveler confirms that they do not knowingly suffer from any condition that would create an unreasonable risk to themselves or others during the trip.
Comprehensive travel insurance is strongly recommended and may be mandatory for certain trips where stated.
9.4 Travel Documents and Entry Requirements
The traveler is solely responsible for ensuring that they hold all required travel documents and comply with all formalities, including but not limited to:
- passport validity,
- visas,
- vaccination certificates,
- health declarations,
- insurance,
- customs requirements,
- and any entry, exit, transit, or import/export regulations applicable to the itinerary.
The traveler is responsible for all costs, losses, and consequences arising from failure to comply with such requirements.
10. Governing Law and Dispute Resolution
These Terms and the agreement between the traveler and Fokus Fotoresor are governed by Swedish law.
Nothing in these Terms limits any mandatory consumer protection rights that may apply under applicable law.
The parties should first seek to resolve any dispute through direct discussion and negotiation.
If a dispute cannot be resolved, the traveler may, where applicable, refer the matter to the Swedish National Board for Consumer Disputes (Allmänna reklamationsnämnden, ARN) or bring the matter before a competent court.
Travel Guarantee / Insolvency Protection
Fokus Fotoresor i Sverige AB maintains travel guarantees and insolvency protection in accordance with applicable Swedish package travel legislation.
This protection is intended to safeguard travelers’ payments and, where transport is included in the package, to help secure repatriation in the event of insolvency.

VAT
Prices for trips within the EU include VAT where applicable.
Trips outside the EU may be exempt from VAT or subject to different VAT treatment depending on the applicable tax rules.
EU Package Travel Rights
The combination of travel services offered to you may constitute a package within the meaning of Directive (EU) 2015/2302 on package travel and linked travel arrangements.
Where your booking constitutes a package, you will benefit from all rights applying to package travel under applicable law. Fokus Fotoresor i Sverige AB will be responsible for the proper performance of the package as a whole.
In addition, Fokus Fotoresor i Sverige AB maintains insolvency protection intended to refund your payments and, where transport is included, assist with repatriation in the event of insolvency.
Key Rights Under the EU Package Travel Directive
- Travelers will receive essential information about the package before concluding the contract.
- There is always at least one organizer responsible for the proper performance of all travel services included in the contract.
- Travelers are given an emergency contact point or equivalent contact details for assistance.
- Travelers may transfer the package to another person, subject to reasonable notice and any justified additional costs.
- The price of the package may only be increased where the contract expressly allows it and only in specific circumstances.
- If the price increase exceeds 8% of the package price, the traveler may terminate the contract without a termination fee.
- Travelers may terminate the contract without paying a cancellation fee if unavoidable and extraordinary circumstances significantly affect the package or the transport to the destination.
- Travelers may terminate the contract before departure against payment of an appropriate and justifiable cancellation fee.
- If significant parts of the package cannot be provided after departure, suitable alternative arrangements must be offered where required by law and at no extra cost to the traveler.
- Travelers may be entitled to a price reduction and/or compensation if the travel services are not performed properly.
- The organizer must provide assistance if the traveler is in difficulty.
- In the event of insolvency, payments are protected and, where transport is included, repatriation protection applies.
